How do I comply with my signage?

According to the Data Protection Act 1998, a person has the right to view any data stored about them that is held by a 3rd party, this includes CCTV footage or images of them or CCTV images that can indirectly supply data about them such as a vehicle registration plate.

For this reason a person has the right to request a copy of any CCTV footage or image that may have been taken of them. This is called a “Subject Access Request”.

In order that a person can find who to contact regarding viewing the footage or images you need to display signage indicating who is the responsible person (the "Scheme Operator”) and how to contact him or her.

How will they contact me?

Any member of the public passing the sign or sticker has the opportunity to find out more details about whether CCTV images have been recorded of them. They may choose to contact the owner of the CCTV system and ask to view the recordings.

The Who Is Watching Me system allows the member of the general public to note down a unique serial number ID that appears on every sign and sticker and then use the website to find out who is the operator of that particular CCTV camera/scheme.

What size signage do I need?

According to the guidelines for good CCTV practice, when a person enters an area where CCTV is operating they should be made aware of this by visible signage.

Signage should be visible depending on how the person approached the area that is being recorded. For example, an A4 Sign is suggested for positioning at ‘head height’ so that passing individuals can be made aware of a scheme. Where it is likely that passing drivers need to be kept informed of the operation of a scheme an A3 sign is suggested.

How many signs do I need?

There is no specific legislation specifying how many signs should be displayed but operators need to remember that they have a duty to inform others of the existence of a CCTV scheme. Every access point to an area that is covered by CCTV should be signposted.
